In this paper, we study the dynamics of legal rules in a model with two nation-states playing a non cooperative game. For each country, changing the legal system is a costly process. At the same time, the existence of different legal systems is also costly for all nation-states. We show that despite the non cooperative behavior of countries, a process of legal convergence is achieved in the long run through small step by step changes. This result depends neither on the number of players in the game, nor on the time horizon of policy makers. Complete legal convergence can be obtained in a finite time. Coordinated efforts to achieve legal convergence are then unnecessary. We show that they might even be counterproductive, in the sense that the welfare of nation-states is higher under legal competition, compared to cooperative legal unification. В статье рассматриваются вопросы становления и развития теории конвергенции, представлен обзор основных идей и взглядов ее создателей. Целью данного ретроспективного анализа является не только исследование конкретной исторической эпохи или определенного этапа формирования государства и общества, но и рассмотрение вопроса эволюции данной теории в правовом пространстве и, как результат, появление нового явления – «правовой (юридической) конвергенции». Тенденция к интенсификации международного взаимодействия права различных стран актуализирует вопросы анализа проблем, связанных с явлением правовой конвергенции, выявления ее сущностных и качественных характеристик, прогнозирования последствий сближения национальных правовых систем. Приводится несколько примеров, отражающих влияние конвергенционных процессов на определение координат развития отечественного законодательства. ; The article deals with the formation and development of the convergence theory, provides an overview of the main ideas and views of its creators. This retrospective analysis of the convergence theory is aimed at not only the study of a specific historical epoch or a particular stage of formation of the state and society, but also the consideration of the evolution of this theory in the legal space, which resulted in appearance of a new phenomenon – «legal convergence (convergence of law)». The trend towards intensification of international cooperation of law in different countries makes more acute the following issues: analysis of problems related to the legal phenomenon of convergence and identification of its essential and qualitative characteristics, predicting the effects of convergence of national legal systems. Several examples, reflecting the impact of convergence processes in the determination of the coordinates of the national legislation, are provided.
